Defence Litigator


BDE Law is a specialist Road Traffic Accident claims firm whose purpose built office is located in the heart of Newport, Wales.

As part of the Admiral Group you will be working for a passionate, profitable and fast growing company that strives to deliver excellent customer service.

This is a great opportunity to join a busy and dedicated team which is made up of solicitors and paralegals of mixed and broad experience on a full time basis. 

What does accident damage litigated defence work mean:

  • You are instructed by an insurer
  • You always act for the defendant
  • The defendant can either be the insurer client or the insurer client’s policyholder
  • It is to defend claims brought by a Third Party as a result of a car accident
  • The Third Party is claiming damages and blames the person insured by our insurer client
  • Damages are mainly repairs costs, policy excess, loss of use, loss of revenue, credit hire charges
  • There is no bodily injury involved
  • All the work is litigated
  • The majority of the work is in the small claims track, so the maximum amount of damages being £10,000

Typical work of a Defence Litigator:

  • Prepare an Acknowledgment of Service
  • Drafting Defence
  • Drafting/completing other Court document such as Directions Questionnaire, Witness Summons, Applications, Draft Orders, Consent Orders
  • Seeking to set a County Court Judgment aside
  • Draft witness statements
  • Preparing trial bundles
  • Draft brief to Counsel
  • Assessing documents – considering whether the Third Party has documents to support their claim for damages
  • Considering liability – accident circumstances
  • Considering the highway code
  • Considering case law
  • Considering legal arguments
  • Seek instructions from insurer client
  • Seek instructions from Policyholders
  • Chase Court for directions / trial dates
  • Deal with cheques / settlement of damages and costs
  • Calculating interest on damages   
  • The candidate should have following experience:
  • Someone with litigation experience desirable, but not essential
  • Good drafting skills
  • Good telephone manner
  • Good IT skills
  • Good at research
  • Team player, but also able to work on their own
  • Uses initiative to get things done
  • Can handle pressure
  • Meet tight/short deadlines
  •  LLB/CILEx
