Litigator

Introduction:

The Defence and Counterclaim Team within BDE Law is seeking a Case Handler to deal with a mixed litigated caseload of bodily injury and accident damage claims / counterclaims. 

This is a great opportunity to join a busy, dedicated and growing team which is made up of solicitors and paralegals of mixed and broad experience on a full time basis. 

The Role:

As part of our dedicated team, you will be representing an Insurer Client and their Policyholders in defending various types of motor and bodily injury claims and/or pursuing these same losses on behalf of an Insurer client and their Policyholders.

You will be expected to deal with claims and/or counterclaims from the commencement of proceedings up to a trial; whilst at all times acting in the best interests of the client(s). 

You will manage your own case load using our case management system.  Whilst you will be supported in your role, you will need to be able to manage your time effectively, ensuring adherence with service level agreements and Court deadlines.  

Being able to prioritise your work in a busy environment will be essential. 

 Below are examples of the work:

  • Complete an Acknowledgment of Service
  • Draft a Defence or Defence and Counterclaim
  • Draft Reply and Defence to Counterclaim
  • Draft and complete other Court document such as Part 36 offers, Directions Questionnaire, Witness Summons, Applications, Draft Orders, Consent Orders, List of Documents, Schedule of Loss, Counter Schedule of Loss, Schedules of Costs
  • Seek to set aside a County Court Judgment
  • Draft witness statements
  • Prepare Trial bundles
  • Draft brief to Counsel
  • Review and advise on special damages
  • Review medical reports and advise on general damages
  • Consider and advise on special damages
  • Consider the accident circumstances, and case law
  • Research legal arguments
  • Speak with Witnesses, Opponents, and Court
  • Negotiate settlements
  • Deal with cheques / settlement of damages and costs

The Applicant should have following skills:

  • Litigation experience in dealing with bodily injury and accident damage claims and/or defence is preferable
  • Strong IT skills
  • Strong grammar, punctuation and drafting skills
  • Good telephone manner
  • Good negotiator
  • Good eye for detail and research
  • A positive attitude and keen to learn
  • Team player, but also able to work on their own
  • Uses initiative to get things done
  • Can deal with a busy environment and always meets deadlines
